On Nov. 5, Senate Environment and Public Works Committee Chair Barbara Boxer (D-Calif.) moved the Clean Energy Jobs and American Power Act (S. 1733) out of her committee without amendments.  The bill has a placeholder for the Energy Refund Program, a cash entitlement that would provide benefits to low-income households whose energy costs would rise as the bill’s energy provisions are implemented

H.R. 2454- American Clean Energy and Security Act of 2009- passed house vote on July 7, 2009.  Waiting on Senate action.


The legislation  prescribes a detailed plan for administering the Energy Refund Program in which states would be mandated to “co-administer” the ERP with the Supplemental Nutrition Assistance Program and utilize many SNAP procedures including electronic benefit transfer
. APHSA has issued a
letter to the Senate objecting to the House provisions and to the fact that the House included no administrative funding for the new program.
